END USER LICENSE AGREEMENT (EULA)
IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY
This End User License Agreement ("Agreement") is a legal contract between you ("Licensee" or "you") and GRP GAMES LTD ("Licensor," "we," or "us") for the software product, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation (collectively, the "Software", "Monkey Mischief").
By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.
LICENSE GRANT
Licensor grants you a non-exclusive, non-transferable, limited license to install and use the Software solely for your personal, non-commercial use, subject to the terms and conditions set forth in this Agreement.
RESTRICTIONS
You may not copy, modify, distribute, sell, or lease any part of the Software, nor may you reverse engineer or attempt to extract the source code of the Software, unless laws prohibit these restrictions or you have our written permission.
You may not use the Software for any illegal or unauthorized purpose.
You may not remove, alter, or obscure any proprietary notices on the Software.
OWNERSHIP
The Software is licensed, not sold. Licensor retains all right, title, and interest, including all intellectual property rights, in and to the Software.
UPDATES
Licensor may provide updates, modifications, or enhancements to the Software at its discretion. Any such updates, modifications, or enhancements shall be deemed part of the Software and subject to the terms of this Agreement.
TERMINATION
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with any terms of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession.
DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of England, United Kingdom, without regard to its conflict of laws principles.
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Licensor concerning the Software and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this Agreement will be binding unless in writing and signed by Licensor.
SEVERABILITY
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions of this Agreement will remain in full force and effect.
By installing or using the Software, you acknowledge that you have read and understood this Agreement and agree to be bound by its terms.
