I’m not expecting them to give it away for free just cus it’s a scammed item. But I think it would be wise for me to atleast let people know it’s stolen. What I expect them to do is be cautious when selling something that was already taken by a scammer to hopefully not have another take it again. Also backpack reports are very black and white considering you can fake report someone and they get banned for doing nothing wrong. Someone I knew got banned from backpack for a very stupid reason and were never really able to trade much after it cus people instantly called them out on the ban.

Okay so then what do you expect someone who has completely legitimately bought it? Just to say bye to the money they spent? I don't understand what you expect people to do. Most items have been scammed from someone at one point or another. It makes sense to punish those that knowingly trade with a scammer but if it isn't known, realistically there's nothing anyone can do that doesn't hurt legitimate traders.

And if you didn't report them, that's your fault. Backpack reports are taken pretty seriously, especially if you have the evidence. You can't say people shouldn't be trading it when you haven't even done the bare minimum to stop it. Literally no one is at fault here.

I was going to but backpack requires the most complicated amount of evidence and if I even tried it would probably would’ve been denied anyways. So I’ve been normally just letting people know, I did report them on steam however and I think they got trade banned cus I got a notification from steam saying one of my reports went through.

Dude, how are people supposed to know its been scammed? You didn't even report the guy to backpack. No one is at fault here as the scammer isn't labelled as a scammer so the trader that bought it isn't at fault at all.
