On page 56, paragraph 4, the condition of "death" is described. Your honor, nowhere in that description does it state that a dead character cannot perform actions, nor does it state that such a character falls prone, and therefore my client's attack of opportunity is has legal merit. Furthermore, in the case of Eric v. DM it was decided that attacks of opportunity were considered "non-actions", and thus even if one were indeed incapable of performing actions one could still perform an attack of opportunity. My opponent's counterclaim of "common sense" is invalid, as common sense suggest a twelve-tonne lizard would be incapable of generating sufficient lift without a wing span of at least two hundred feet. Its seeming ability to breathe fire of course would be right out, and ergo if we wish to use the principle of common sense, then we must also ignore the fact that this 'dragon' flew up to my client and breath attacked them for double their max HP, and thus the "dead" condition is inapplicable in the first place.
